Dear Mr. O'Brian:
In accordance with Rule 1.4.9(2)(c) of the Mineral Rules and Regulations of the Colorado Mined Land
Reclamation Board for the Extraction of Construction Materials, attached is the Division's Rationale and
Recommendation for Approval with Conditions Over Objections for the Albert Frei and Sons, Inc. - Priola
Pit, New 112 Application, Permit No. M-2007-087.
As stated in the Division's correspondence dated May 28, 2008, the pre-hearing conference is scheduled for
Wednesday, June 18, 2008, at 9:00 am at the Division's office at 1313 Sherman Street, Room 215, Denver,
Colorado. The formal board hearing is scheduled for the July 9-10 meeting of the Mined Land Reclamation
Board, in room 318 of the same building. The board will convene at 9:00 am on July 9.
Please examine Rule 2.6, PRE-HEARING PROCEDURES - MOTIONS, WITNESS AND EXHIBIT
LISTS, for a description of materials that each entity having party status must provide to the pre-hearing
conference and to the formal board hearing.
