The AVS recommendation is Deny. There are now 22 violations linked to the permit. In <br />my memo dated November 25, 1997,1 noted nine violations associated with Barrenshe Coal Inc., <br />a company linked to Kaiser Ventures through Reynold C. MacDonald. MacDonald is a director <br />of Kaiser Ventures. MacDonald is noted as a controller of Olga Coal Co. who owns Barrenshe <br />Coal Inc. There are 7 state violations, one bond forfeiture, and one audit violation linked to <br />Reynold MacDonald. <br />The remaining 12 violations are linked through William J. Morgan who is listed as a director of <br />Kaiser Ventures. William Morgan is directly associated with Johnson & Morgan and John A. <br />Thompson Coal Co. Inc. There are 3 bond forfeitures, 3 cessation orders, 5 state civil penalties, <br />and one audit violation linked to William Morgan. <br />You should inform the operator of these violations. Due to the court's ruling which eliminates <br />OSM's ability to permit block an application, we should talk to Larry Routten and/or Susan <br />McCannon about how we should proceed on this matter.
