In 1982, Randall Blake of Oklahoma, Inc. filed bankruptcy under Chapter 7 of the Bankruptcy Code, Case Number 82-00542. As a portion of this proceeding, ODM, Randall Blake of Oklahoma, Inc., through the bankruptcy estate trustee, and other associated parties, entered into a Settlement Agreement to resolve all reclamation obligations and all civil penalties due ODM. This agreement was subsequently approved by the Bankruptcy Court. On or about June 7, 1993, the Settlement Agreement had been fully performed. . As the Applicant Violator System (AVS) did not exist at the time of the Settlement Agreement or, at least, not in its fully implemented form, the subject Settlement Agreement was inadvertently omitted during subsequent AVS implementation. At the present time, the Settlement Agreement has been entered into the AVS and all obligations of Randall Blake of Oklahoma, Inc. have been satisfied. No penalties remain unpaid. 4040 N.
