As a portion of this proceeding, ODM, Randall Blake of Oklahoma, <br />Inc., through the bankruptcy estate trustee, and other associated parties, entered into a Settlement <br />Agreement to resolve all reclamation obligations and all civil penalties due ODM. This agreement was <br />subsequently approved by the Bankruptcy Court. On or about June 7, 1993, the Settlement <br />Agreement had been fully performed. <br />. As the Applicant Violator System (AVS) did not exist at the time of the Settlement <br />Agreement or, at least, not in its fully implemented form, the subject Settlement Agreement was <br />inadvertently omitted during subsequent AVS implementation. At the present time, the Settlement <br />Agreement has been entered into the AVS and all obligations of Randall Blake of Oklahoma, Inc. <br />have been satisfied.
