• Previous surveys of the Dry Fork Lease area for cultural resources identified one site, a <br />segment of the Deep Creek Ditch, as potentially eligible for the National Register of <br />Historic Places. The site was determined ineligible for the National Register as <br />confirmed by the State Historic Preservation Officer's letter dated October 11, 2007. <br />More recent evaluations of the Dry Fork Lease area conducted by the USDA Forest <br />Service archeologist determined that the project has no potential to effect cultural <br />resources. The protection and preservation of previously unidentified prehistoric or <br />historic resources is ensured by both a condition of the CO-DRMS issued permit and the <br />Assistant Secretary Land and Minerals Management's mining plan approval. <br />The Final Environmental Impact Statement entitled, Dry Fork Lease-By-Application, <br />(COC-67232) (August 2005) prepared by the USDA Forest Service, with OSM and BLM <br />as a cooperating agencies, describes the impacts that may result from approval of this <br />mining plan modification and its alternatives. OSM, as a cooperator, has independently <br />reviewed the EIS and concludes that its comments and suggestions have been satisfied; <br />therefore, OSM adopts this EIS. A summary of the above described EIS is included in <br />this decision document. The full EIS is available from Charles Richmond, Forest <br />Supervisor, Grand Mesa, Uncompahgre, Gunnison National Forests, 2250 Highway 50, <br />Delta, Colorado, 81416. <br />OSM's review of the proposed action did not identify any issues that required resolution <br />via the addition of special conditions to the mining plan modification approval. <br />• <br />On November 28, 2007, Mountain Coal Company, L.L.C. published in the Delta County <br />Independent the fourth consecutive weekly notice of the availability of an <br />administratively complete permit application package. During the review of Permit <br />Revision PR-12 CO-DRMS received five (5) public comments. An explanation of each <br />public comment can be found in the State Decision Document made a part of this <br />Mining Plan Modification Decision Document <br />On March 26, 2008, Mountain Coal Company L.L.C. published a newspaper notice in the <br />Delta County Independent notifying the public of CO-DRMS' proposed decision. <br />The CO-DRMS determined that a reclamation bond in the amount of $14,000,000.00 is <br />adequate for the total reclamation of Colorado Permit C-1980-007 associated with this <br />mining plan. The bond is payable to the State and the United States of America. <br />A chronology of events related to the processing of the PAP and this mining plan decision <br />is included with the decision document. The information in the PAP, and other <br />information identified in the decision document, has been reviewed by CO-DRMS staff <br />in coordination with the OSM Federal Lands State Coordinator. <br />0
