Conser,"ation recommendations are discretionan, agency activities to <br />minimize or, avoid adverse effects of a proposed actior on listed species or critical_ habitat. to <br />• help implement recovery plans. or to develop information. <br />The Service recommends that the Forest Ser vice require, as part of any permit issued for the <br />proposed action the following items: <br />The applicant to establish an education program to educate employees of the mine about <br />the presence of lynx, and safe driving practices. <br />The applicant and employees to report. within 24 hours, the sighting of any lynx, or the <br />carcass of any lynx they may encounter. <br />The applicant provides an annual report of all activities falling under the auspices of the <br />proposed action, which may affect lynx, to both the Forest Service and the U.S. Fish and <br />Wildlife Service. <br />REINITIATION NOTICE <br />This concludes consultation for the potential effects of the three actions evaluated on the Canada <br />lynx. As provided in 50 CFR 402.16, reinitiation of formal consultation is required where <br />discretionary Federal agency involvement or control over the action has been maintained (or is <br />authorized by law) and if: I ) the amount or extent of incidental take is exceeded, 2) new <br />information reveals effects of the agency action that may affect listed species or critical habitat in <br />• a manner or to an extent not considered in this opinion, 3) the agency action is subsequently <br />modified in a manner that causes an effect to the listed species or critical habitat that was not <br />considered in this opinion, or 4) a new species is listed or critical habitat designated that may be <br />affected by the action. In instances where the amount or extent of incidental take is exceeded, <br />any operations causing such take must cease pending reinitiation. <br />Thank you for your continued interest in the conservation of endangered. threatened, and <br />proposed species.
