• CHRONOLOGY <br />West Elk Mine <br />Federal Lease COC-67232 <br />Mining Plan Decision Document <br />DATE EVENT <br />February 10, 2006 The U.S. Fish and Wildlife Service provided its final consultation <br />comments regarding threatened and endangered species associated <br />with the Dry Fork Lease-by-Application (COC-67232) tract. <br />March 6, 2006 The Federal land management agency, USDA Forest Service, <br />issued its Record of Decision for its concurrence to the Bureau of <br />Land Management's leasing of the Dry Fork Lease-by-Application <br />(COC-67232) tract with respect to the management of Federally- <br />owned lands under its control. <br />October 1, 2007 Mountain Coal Company, L.L.C. submitted the permit application <br />package (PAP) under the approved Colorado State Program to the <br />Colorado Division of Reclamation, Mining and Safety <br />(CO-DRMS) for a permit revision at the West Elk Mine. <br />October 5, 2007 The State Historic Preservation Office provided its comments on <br />the permit application. <br />October 30, 2007 The Bureau of Land Management provided its findings and <br />recommendations on the approval of the mining plan, with respect <br />to the Resource Recovery and Protection Plan. <br />November 28, 2007 Mountain Coal Company, L.L.C. published in the Delta County <br />Independent the fourth consecutive weekly notice of the <br />availability of an administratively complete PAP. <br />March 21, 2008 <br />March 24, 2008 <br />April 25, 2008 <br />CO-DRMS issues its Proposed Decision and Findings of <br />Compliance for Permit Revision No. 12. <br />The USDA Forest Service provided its formal concurrence with <br />the approval of the mining plan with respect to the management of <br />Federally-owned lands under its control. <br />CO-DRMS Proposed Decision and Findings of Compliance for <br />Permit Revision No. 12 became final. <br />
