IV. ENFORCEMENT ACTIONS <br /> The following identifies enforcement actions taken during this inspection, the required abatement and <br /> date of abatement for the violation, previous violations still requiring abatement and the termination of <br /> violations cited during previous inspections. <br /> No enforcement actions were taken based on this inspection. <br /> NOV CV-2008-001 was modified by the Division by Notice dated 6/2/08. Abatement Items 1 and 2 <br /> were modified, and Abatement Item 3 was deleted. Modified Abatement Item 1 was complied with <br /> based on submittal of P.E. certified Pond 12 survey documentation, received by the Division on <br /> 5/29/08. Abatement Item 2 remains in effect. <br /> NOV CV-2008-001: Abatement Item 2 <br /> No later than June 30, 2008, provide a complete technical revision application, which will include a <br /> slide remediation plan prepared by a qualified geotechnical engineer. The remedial plan will identify <br /> and assess the factors that contributed to the failure, will include specific remedial measures to be <br /> implemented to repair the slide and effect compliance with the applicable requirements of Rule 4.14, <br /> and shall include a geotechnical stability analysis demonstrating that the remedial plan will result in a <br /> final slope that will comply with Rule 4.14.2(1)(b). The application will also address both short term <br /> and long term measures that will be taken to provide adequate sediment controls in the Pond 12 <br /> watershed, consistent with long term mass stability of the failed slope. Short term measures may <br /> include cleanout of Pond 12, if the geotechnical report demonstrates that such cleanout can be <br /> accomplished without compromising slope stability. The application will include a schedule for <br /> implementation of the slide remediation plan, including the short term and long term sediment control <br /> measures for the Pond 12 watershed. <br /> NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br /> Revised 2/97 <br /> 4 <br />
