III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the field inspection. The weather was warm and the entire mine site and surrounding area were clear of <br /> any snow. <br /> Roads <br /> The road up the Hubbard Creek drainage was dry and in good condition, as was the mine road across Hubbard <br /> Creek. The road to pond 5 was a little marked up by a recent herd of sheep but the road was passable. The mine <br /> entrance gate was closed and locked. <br /> Hydrology <br /> The sediment control system was operating properly. There was a little standing water in pond 4. The spillways <br /> were functional. The pond 4 embankment was well grassed. The road culvert that brings runoff from the <br /> reclaimed coal stockpile area into pond 4 was clear. The upland diversion ditch at the reclaimed coal stockpile <br /> area was well grassed and had sufficient capacity. <br /> There was a little standing water in pond 5. The pond 5 spillways were functional. The collection ditch leading <br /> into the north side of pond 5 was well vegetated and had enough capacity. <br /> There was a slow but steady dripping of water coming out of the north end underdrain while the central and <br /> south underdrains were dry. There was a wet seep in the central part of the reclaimed mine site and a smaller <br /> seep in the northern part of the mine site, although the two seeps weren't flowing.The inlet and outlet of the <br /> black culvert that brings water from the upper terrace down toithe pond 5 collection ditch were clear. The <br /> culvert in Hubbard Creek at the mine entrance was clear as well. The creek was running high and swift. <br /> Signs and Markers <br /> The surface disturbance markers were up around the reclaimed site. The mine ID sign was up on the front gate <br /> and the required information was on the sign. The"records location" sign also was on the front gate. <br /> Reclamation <br /> The reclaimed mine site was stable. There were no signs of slope instability, nor were there problems with <br /> erosion. The backfilled slopes and terraces were well vegetates. The reclaimed coal stockpile area was also well <br /> vegetated,although the sheep grazed the vegetation rather sho�t.No noxious weeds were spotted. <br /> c:/word/blueri bbon/insp0608 <br />
