JUL COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator. The site was dry but it started to rain a little near the end of the inspection. <br /> Noxious Weeds <br /> The operator recently sprayed for whitetop around the loadout site. <br /> Facilities <br /> There were no problems at the loadout office, substation or the material storage area on the east side of the <br /> loadout site. There were no fuel leaks or other problems at the fuel facility. <br /> During the inspection, coal haul trucks were unloading and coal railcars were being loaded. In spite of these <br /> activities and the moderate volume of coal stockpiled on the facilities bench,there were no indications of <br /> fugitive dust. <br /> Hydrolo�y <br /> There was a small volume of standing water in the east side pond. The primary gated valve was closed and the <br /> emergency spillway was functional. The pond embankment was well vegetated. The pond inslopes were stable. <br /> The west side dugout pond was dry. <br /> The silt fence and straw bales associated with the railroad track small area exemption were in place. Culverts at <br /> the loadout were clear and the ditches had sufficient capacity. <br /> Roads <br /> The paved main haul road was in good condition. The guard rail was in place. There were no coal fines or debris <br /> on the haul road.There were no indications of coal tines or coal dust on the highway at the loadout main <br /> entrance either. The east side graveled entrance road was in good condition. The gate at the east entrance was <br /> open.The light use road along the railroad tracks was passable. <br /> Topsoil <br /> The topsoil stockpile on the west end of the loadout was well vegetated. The collection and diversion berm/ditch <br /> was in place and was also well vegetated. The topsoil sign was up on the stockpile. There were no indications of <br /> erosional problems. The topsoil stockpile on the east side of the loadout had a good vegetative cover. The <br /> collection ditch and the diversion ditch had enough capacity. There were no signs of erosional gullying. The <br /> topsoil signs were up on this stockpile as well. <br /> Sims and Markers <br /> The mine ID signs were up at the main entrance,east entrance and adjacent to the side road near the railroad <br /> tracks.
