III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Bear Coal Company, during the inspection.It was raining during the inspection. The entire reclaimed <br /> mine site was wet. The adjacent North Fork of the Gunnison River was running high and fast. <br /> Sims and Markers <br /> The mine ID sign and post were on the ground at the top of the hill.The sign and post need to be put back up. <br /> The"no trespassing" sign was up on the entrance gate. <br /> Facilities <br /> The entrance gate to the mine site was closed and latched but not locked.Nothing has changed at the <br /> demolished and burned mine office. The debris is still on site. The power company cable also remains on site, <br /> running from a transformer at the top of the hill down the paved road and across the bridge to the mine site <br /> transformer.The power company did this to facilitate repairs elsewhere. <br /> Roads <br /> The paved haul road was passable. The hole in the road at the west end of the bridge has been mostly filled in. <br /> The bridge was passable. <br /> Hydrolo�y <br /> The water level in the sediment pond was up to the primary discharge pipe gated valve. The valve was closed. <br /> There was water in sections of the collection ditch that brings disturbed area runoff into the sediment pond. The <br /> berm along the river was in place and had sufficient height. The caps were on both of the alluvial well pipes. <br /> The upstream alluvial well is located next to the sediment pond collection ditch. A pool of standing water was <br /> seen in the ditch next to the alluvial well. <br /> The hillside spring water treatment pond was discharging at about 10 to 15 gpm. The pond discharge was the <br /> usual orange color,which has been found to be in compliance with water quality standards. The hillside spring <br /> was flowing within its channel to the culvert that takes it into the treatment pond. <br /> Noxious Weeds <br /> Tamarisk was found near the entrance gate,at the hillside spring water treatment pond and around the hillside <br /> spring area. Whitetop was found around the site. These noxious weeds need to be sprayed. <br /> c:/word/bear3/insp0608 <br />
