M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. The Hawks Nest mine <br /> is a forfeited and revoked site that was reclaimed by the State using forfeited reclamation bond money. <br /> Since October 22, 2005, the required inspection frequency has been for one complete inspection and <br /> three partial inspections per year. It rained during the entire inspection. <br /> Roads <br /> The old state highway provides access to the reclaimed east site and west site. There are no mine <br /> roads. The highway was in good condition. Two small mud slides have moved to the north edge of the <br /> highway but currently are not a problem. <br /> Hydrology_ <br /> There was a small volume of standing water in the west pond. The pond's concrete spillway was clear. <br /> The pond embankment was well vegetated. The road culverts and riprapped channels were in place <br /> and were functioning properly. <br /> Signs and Markers <br /> Because this is a revoked site, there are no mine ID signs or mine records. No surface disturbance <br /> markers exist either. There are several stream buffer zone signs associated with the west pond, <br /> however. <br /> Reclamation <br /> The reclaimed east site and west side are well vegetated. No problems with erosion were observed on <br /> reclaimed lands. <br /> Slides and Damage <br /> The two mud slides adjacent to the north side of the highway are located where mud slides have <br /> occurred before.
