unsurveyed areas within 60 days of mining plan approval. <br /> Another special condition was added to the mining plan <br /> • approval which requires the applicant within 60 days of <br /> mining plan approval to submit a plan for mitigating the <br /> effects of subsidence on any cultural resources which have <br /> been determined to be eligible for inclusion on the National <br /> Register of Historic Places. Both the survey and the <br /> mitigation plan must be developed in conjunction with OSMRE, <br /> the Colorado State Historic Preservation Officer, The Bureau <br /> of Land Management (BLM) and Colorado MLRD. A meeting is <br /> scheduled for May 29, 1986, to discuss mitigation plans for <br /> a cultural resource site which will be undermined in 1987. <br /> 2) The biologicallassessment conducted for the permit revision <br /> area raised the concern that black-footed ferrets, a <br /> threatened and endangered species, might be impacted by the <br /> surface disturbances at the refuse disposal site. Although <br /> no ferrets were found during surveys conducted in 1980 and <br /> 1985, white-tailed prairie dogs which are a primary food <br /> source of ferrets, exist near the refuse disposal site. <br /> Therefore, black-footed ferrets could move into the area and <br /> be impacted by these surface disturbances. A special <br /> condition has been added to the mining plan approval which <br /> requires the applicant to conduct surveys of prairie dog <br /> concentrations for black-footed ferrets using methods <br /> approved by the U.S. Fish and Wildlife Service (FWS) . The <br /> surveys must be conducted one year prior to any surface <br /> disturbances, ''and must be submitted to the FWS and OSMRE for <br /> review and evaluation. <br /> 3) The BLM raised a concern about the Darwin Reservoir and its <br /> effectiveness as a stock watering facility being disrupted <br /> by the Deserado mine refuse disposal pile. The BLM <br /> requested that the applicant commit to replace the reservoir <br /> with an alternative stock-watering supply. The applicant <br /> has made this commitment. <br /> The public was notified of the availability of the PAP for review by <br /> publication of newspaper notices for four consecutive weeks ending <br /> November 28, 1985. No public comments on the PAP were received <br /> after the public notice was published. <br /> A technical analysis of the proposed mining and reclamation <br /> operations was prepared by Colorado MLRD and was included in the <br /> documentation provided by Colorado MLRD to OSMRE pursuant to the <br /> cooperative agreement.' The environmental assessment of the proposed <br /> action and alternatives was prepared by OSMRE. These documents, <br /> other documents prepared by Colorado MLRD, the company's PAP, and <br /> other correspondence developed during the completeness and technical <br /> reviews are part of OSMRE's administrative record. <br /> 11 <br />
