-L- <br /> Proposed Decision <br /> Western Fuels Association, Inc. <br /> Deserado Mine <br /> C-81 -018 <br /> The Colorado Mined Land Reclamation Division proposes to approve an <br /> application for a permit revision to add three Federal coal leases to the <br /> existing underground mining operation. This decision document is a <br /> modification of the June 4, 1981 decision document, for the initial Permanent <br /> Regulatory Program Permit issued to Western Fuels Association, Inc. for the <br /> Deserado Mine on July 27, 11981 . Findings regarding legal , financial , and <br /> compliance information, cultural and historic resources, geology, hydrologic <br /> balance, cumulative hydrol',ogic impacts, alluvial valley floors, threatened and <br /> endangered plant and animal species, bonding, subsidence, and reclamation fees <br /> within the original findings document have been modified as necessary to <br /> reflect the addition of Federal Coal Leases C-8424, C-8425, and C-0126669. <br /> Additionally, all stipulations attached to the June 4, 1981 decision document <br /> which have been satisfied !(Stipulation Nos. 1 , 3 through 25, 27, 28, 29, 30 <br /> and 31 ) by the permittee have been deleted from this document. Stipulations <br /> 2, 26, 32, 33, and 34 which are ongoing in nature have also been deleted from <br /> this document by virtue of the permittee providing acceptable written <br /> commitments in appropriate sections of the revised permit application to <br /> comply with the specific requirements of each on-going stipulation. <br /> Documentation of the resolution process for each stipulation is provided in <br /> the mid-term review document available from the Division. <br /> This approval decision is based on a finding that the proposed operation will <br /> comply with all requirements of the Colorado Surface Coal Mining Reclamation <br /> Act, C.R.S. , as amended, 34-33-101 et sue. , and the regulations promulgated <br /> pursuant to the Act. <br /> The permit revision application will become a binding part of the permit upon <br /> approval . <br /> I <br /> i <br /> w <br />
