SUBJECT: Recommendation for Approval of Western, Fuels-Utah, Inc. 's
Deserado Mine Mining Plan, as Modified:, Rio Blanco County,
Colorado, Federal Leases: C-023703, D-047201, C-8424,
C-8425 and C-0126669:
I. Recommendation
I recommend approval with conditions of the Western Fuels-Utah,
Inc. 's Deserado mine mining plan,, as modified. Approval of this
mining plan,- as modified, will supersede the mining plan approved on
July 15, 1981, for the existing Deserado underground mine. My
recommendation is based on the complete permit application package
(PAP), updated to February 21, 1986., an environmental assessment of
the proposed mining and reclamation operations and alternatives
prepared by the Office of Surface Mining Reclamation and Enforcement
(OSMRE), a technical analysis, and the administrative record.
Approval of the mining plan, as modified, will authorize mining of
approximately 8.2 million additional tons, of. Fede.ral coal. within the
mining plan area which covers 9,152 acres within Federal leases .
C-023703, D-047201, C-8424, C-8425,, and C-0126669, as .shown on the
maps included with this memorand.um.: . During the review of the PAP,
certain elements of the applicant's proposal were identified .that
require special conditions to comply with Federal law. Those
special conditions are incorporated into the proposed mining plan
approval document.
In conjunction with OSMRE's processing of this mining plan
modification, OSMRE also reviewed the previously approved mining
plan and the Federal permit number CO-0038 issued on July 23, 1981,
for the Deserado mine. All terms and conditions of the Federal
permit will be covered by the Colorado permit number C-81-018 and
the mining plan approval document. Because the Secretary of the
Interior and the State of Colorado have entered into a cooperative
agreement which provides for the delegation to the State-`of the
permitting responsibilities for operations on Federal lands pursuant
