0 <br /> Office of Surface Mining Findings At the Time of <br /> Mining Plan Approval <br /> • <br /> 1. The Office of Surface Mining Reclamation and Enforcement (OSMRE) <br /> has reviewed the operation and reclamation plan portion of the <br /> Deserado mine permit application and determines that it complies <br /> with the Surface Mining Control and Reclamation Act of 1977 <br /> (SMCRA), the Federal Lands Program, and all other requirements of <br /> applicable Federal laws. (See Environmental Assessment and Findings <br /> and Supporting Documentation.) <br /> 2. After reviewing the description of the proposed area of the mining <br /> plan approval, OSMRE determines this area is: <br /> a. Not unsuitable for mining in accordance with section 522(b) <br /> pursuant to section 522(a)(2) of SMCRA. (See Environmental <br /> Assessment, Findings and Supporting Documentation and BLM <br /> Correspondence dated July 16 and December 23, 1985.) <br /> b. Not unsuitable for mining in accordance with section 522(b) <br /> pursuant to standards set forth in section 522(a)(3) of SMCRA. <br /> (See BLM correspondence dated July 16, 1985, December 23, 1985, <br /> and May 22, 1981.) <br /> c. Not on any Federal lands within the boundaries of any national <br /> forest.
