SMipm <br />SuM rry+wr <br />In response to your fa:ed request for response to whether DWR has any authority over <br />wells subject to the jurisdiction of the Mined Land Reclamation Board. I refer to the <br />'Regulations of the Colorado Mined Lana Reclamation Board for Coal Mining' rule 4.Ob.f 3(1) <br />Grpund Wetar, part a) which states that: <br />C~ <br />'Groundwater levels, infiltration rates, subsurface flow end storage <br />charecterlstlcs, and the quality of ground water shall ba monitored in e <br />manner aooroved by the Divisio0,after consultation with the Division of <br />Wets Resources ....' (emphasis sddedl. <br />The Division of Water Resources In correspondence with you end DMG has provided <br />information regarding monitoring end observation walla permitted end regulated by DWR. <br />1 believe that DMG'a authority supersedes DWR'8 by virtue of this rule as well as 3.2 of <br />pWR's Water Well Conatructlon Rules if DMG chooses to Impose Its own rules in lieu of those <br />of DWR rogerding monitoring and observation wells.
