MiCKy Sandquist <br />Yuma County Highway Department <br />1310 South Blake Street <br />Wray, Colorado 80758 <br />Re: Brand Pit, M-81-250; Galvin Pit, M-81-260 <br />Dear Ms. Sandquist: <br />Enclosed is the legal right to enter statement that was submitted to include <br />Permits M-81-249 through M-81-271. This statement is in compliance with <br />Rule 3.11(12) which requires: "The operator shall submit a copy of the <br />lease, deed, abstract of title, or current tax receipt. In lieu therefore, <br />a statement acknowledged by a notary public that the operator has the right to <br />enter and mine will be accepted." <br />The right to enter, in this case, is in compliance with the law and remains <br />valid unless the Division received written notice that the operator does not <br />have the right to enter. Our permit does not guarantee the right to continue <br />mining the site if lease agreements change. <br />I want to emphasize that while a notarized statement complies with the <br />Mined i_and Reclamation Act it may not be a legally binding agreement. Yuma <br />County should consult with legal counsel on this matter. <br />In regard to cessation of mining, an operator must begin reclamation immediately <br />unless the cessation may only be temporary. If there is a chance for <br />resumption of mining activities than the operator should file a notice of <br />temporary cessation with the Division. This cessation allows for a period, <br />not to exceed five (5) years, in which to reactivate the pit.
