Box 771218 • Yampa Valley Electric Association November 14, 2007 Hayden Gulch Terminal, Inc. 701 Market Street, Suite 700 St. Louis, MO 63101- 1826 Steamboat Springs Colorado 80477 Re: Substation facility and electrical equipment removal at Hayden Gulch Loadout To Whom It May Concern: Yampa Valley Electric Association (YVEA) currently has a power substation associated with the Hayden Gulch Loadout facility, formally owned and operated by H-G Coal Company (HGCC). Title for the land where the substation is located was transferred to YVEA in a deed recorded in Book 454 on Page 657. Equipment located at the substation is the property of YVEA. Due to the location and the nature of the substation some of its equipment is used to service other areas and facilities. In addition to transferring title for the substation location, HGCC also granted YVEA aright-of--way easement fora 69KV electrical transmission line that crosses the Hayden Gulch Loadout facility area permitted with the Colorado Division of Reclamation, Mining and Safety. This easement is recorded in Book 454 on Page 655. The poles, wires and other facilities associated with the transmission line are the property of YVEA YVEA will remove, at the land owners request and expense, the electrical facilities at the substation that are exclusively for the Loadout facility operations. When requested to remove the substation, an engineer with YVEA will design the project. Until the new design is created, an exact accounting of what equipment will remain is not possible. The 69KV transmission line services other facilities and areas besides the Hayden Gulch Loadout and, consequently, will not be removed. Please contact me at (970) 871-2250 if there are any questions.
