COMl~~NT NO. 5 <br />There appear of record at Book 907, Reception No. 1829039, and at Book 1159, Reception <br />No. 2102244, plats of the Keenesburg Mine Site. These plats reflect that coal mining activity is or <br />was present on the captioned lands. In that regard be advised that C.R. S. Section 34-61-101, requires <br />that the owzier or person in charge of any borehole which penetrates any workable coal seam or any <br />accessible or inaccessible coal mine, shall notify the state oil and gas conservation commission of <br />the location of the borehole by designating the particular five-acre subdivision of land section on <br />which the borehole is located, and the depth and thickness of every workable coal seam or mine <br />penetrated by such borehole. C.R.S. Section 34-16-102, regulates the location of any borehole <br />penetrating a gas or oil bearing formation relative to coal mines, entrances, shafts and appurtenant <br />equipment. C.R.S. Section 34-16-103, requires that any borehole penetrating any workable coal <br />seanl shall be cased to prevent surface water from entering the coal seam. Addi#ional regulations <br />are set forth in G.R.S. Sections. 34-61-104 through 108. <br />~UIREMENT 1~T0. 5 <br />P17C must conduct its operations cognizant of and in compliance with all applicable laws, <br />rules and regulations mandated by coal mining operations on or about the captioned lands. <br />COMMENT N0.6 <br />By Conveyance, Assignment and Bill of Sale dated December 4,1991, effective December <br />1, 1991 at 7:00 a:m., recorded. December 1 1, 1991 at Book 1319, Reception No. 2271815, TMR <br />Acquisition L.P., Vi~alker Energy Partners, Walker Energy Partners Ltd., Walker Energy Operating <br />Ltd., Meridian Resources Ltd., Texas Meridian Operating; Ltd.,., and Texas Meridian Production <br />Company, Ltd., purports to assignto Transfuel Resources Company, all right, title and interest in and <br />to, among other, the captioned lands. As of the date of this Assignment the Assignors do not appear <br />to own any interest in Oil and Gas Lease No. 1 above as to the captioned lands. <br />REQUIREMENT 1`TO.6 <br />For absolute assurance of title it would behoove FDC to verify that none ofthe parties to tl2e <br />aforesaid Assignment claim any interest in the captioned lands adverse to its interest therein. <br />COMMENT NO. 7 <br />The chain of title to the leasehold estate contained many more assignments then those <br />summarized herein.
