Regulatory Agency: Railroad Commission of Texas <br />Violation 27A The permittee discharged surface water from final discharge sedimentation <br />• Ponds 24 and 30 which failed to meet the Total Suspended Solids specified in <br />the current TNRCC discharge Permit No. 02653. <br />Action: The permittee shall immediately take action necessary to prevent the discharge <br />of waters with TSS Concentrations in excess of the discharge limits including but <br />not limited to treating the sediment ponds with chemical agents designed to <br />reduce suspended solids, vegetating or mulching watershed areas to reduce the <br />inflow of sediment and repairing inlet structures to reduce erosion of the pond <br />slopes. <br />Terminated: On January 23, 2002, RCT Modification extended the time for abatement for 30 <br />days to February 19, 2002, the requested .additional time necessary for the <br />development and implementation of corrective actions and the approval of <br />submitted plans for cited areas. <br />Final Termination: March 2, 2002 , <br />Fine Assessed: $3500.00 <br />Texas, Jewett Mine, Permit 32E <br />MSHA #41-03164 <br />January 10, 2002 <br />Regulatory Agency: Railroad Commission of Texas <br />Violation 28A The permittee failed to construct and maintain the D4 diversion using the best <br />technology currently available.to prevent additional contributions of suspended <br />solids to streamflow outside the permit area. <br />Action: The permittee shall immediately take any action necessary to repair and maintain <br />• the D4 diversion. <br />Terminated: On January 23, 2002, RCT Modification extended the time for abatement for 30 <br />days to February 19, 2002, the requested additional time necessary for the <br />development and implementation of corrective actions and the approval of <br />submitted plans for cited areas.
