Ben Frei <br />Subject: RE: Priola Pit <br />Hey, Ben. <br />Sorry for the confusion and delay - after reading the agreement I wasn't entirely sure what it was <br />binding us to and I was confused as to why you referred to it as a waiver, so I had our <br />engineer review it and the regs for me. When you & I spoke about the agreement a couple weeks <br />back, I didn't understand that it essentially waived our request for a response to the concerns we <br />outlined in our letter. Even though the site visit gave our us a better understanding of the <br />proposal, we still need our concerns addressed fonnally. With the activity occurring so close to <br />our slurry wall and major storage reservoir, the City won't be able to agree to a simple <br />reimbursement of damages should something unforeseen occur during your operation. I know <br />the fonnal process adds time and expense on your end, but this is our primary terminal storage <br />reservoir and we need to make sure that it's not unintentionally compromised.
