Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation Mining and Safety (DRMS) has received Deep Cut Irrigation Ditch's timely <br />comments in regard to the above referenced I I2c reclamation permit. Those comments have been forwarded on <br />to TMS Consulting who represents the applicant with a request to address them directly. It is the Division's <br />understanding that there has already been dialog between the parties. In fact it is noted that Deep Cut Ditch <br />signed a damage repair agreement with the applicant on 4-24-08. However, based on the nature of the comment <br />letter the Division.has classified it as an objection to the application. If this is incorrect please contact staff as <br />soon as possible to clarify the nature of the comments. <br />As an objector Deep Cut Ditch is classified as a party to the permit application process. Please find enclosed a <br />copy of "Guide to Citizen Participation in the 112 Reclamation Permit Application Process for Construction <br />Material and Hard Rock Mining Operations". Please take the time to read the guide as it explains your rights and <br />responsibilities as a party to the permit process proceedings. <br />A review of Deep Ditch's comments from May 9 and May 21, 2008 identifies some concerns that the Division <br />also reviews as a matter of normal procedure. The Ditch's comments on hydrology and stability have been passed <br />on to the Division's engineer and hydrology specialist for further review. Their comments will be available to the <br />public once they have been received back by staff. <br />Other comments noted in the letter can hopefully be addressed within this correspondence. <br />Issues 1 through 4 are being reviewed as noted above by the Division's engineer and hydrology specialists. <br />Issue #5 notes weed infestations in the area. <br />DRMS requires weed control with all applications. Staff inspects all permitted sites on a regular schedule and <br />noxious weed infestations and controls are part of those inspections. If noxious weeds are observed the operator <br />must submit an approved control plan for those weeds approved in conjunction with the County Weed Control <br />Division.
