<br />Answer, Page 4(con't) Subsequently, I sent a written <br />"Petition for Redress of Grievances" to Kathleen Clark, <br />Director of BLM in Washington, with copies to Gale Norton, <br />Dick Cheney, and George W. Bush. After another month's delay <br />with no response, I filed a Civil Lawsuit to seek a reasonable <br />settlement with an outcome different than that at the Joker <br />Mill, which was a similar matter handled by the same BLM people. <br />Of course, the result at the Joker Mill was the complete <br />and very premature destruction of the $3.2million facility <br />against the owner's wishes. This court action was initiated <br />to prevent a similar outcome at the Ace #7 mine, following <br />the foregoing sequence of unsuccessful appeals clear to the <br />top of the chain of command. I could see in reading the file <br />on the Joker Mine Permit, that almost identical letters and <br />series of phony and fabricated reports were made by the same <br />group of BLM and others who had combined together in an illegal <br />interaction to achieve the theft of the Joker Mill from its <br />rightful owner, Orvie Zimmerman and family. Thus Rob Ernst was <br />successful in instilling a fear in me that they would similarly <br />proceed at the Ace#7, just as the language in his 1999and2000 <br />inspection report indicated. This is the reason I requested a <br />Stay from the Court to prevent such destruction. <br />5. In answer to Part C(page 10 of Defendant's Motion to <br />Dismiss, stating my claim is moot, I would state that as far <br />as the 43CFR3809 regulations are concerned, that the pattern <br />of abuses established in the destruction of the Joker MIll in <br />2002-2004 is reason enough to remove the entire section of <br />regulation from the'body of the law based on its actual misase <br />S'lNi??gL <br />and abuse by BLM personnel in a mannerA to what Rob Ernst and <br />John Husband verbally threatened repeatedly and put into writing <br />in the Sept.2000 inspection reports at the Ace#7 Mine and in <br />similar documents provided by Earnst and Husband to Orvie <br />Zimmerman, prior to the destruction of the Joker MIll. <br />The "injury in fact" occured on Sept. 26,2000 when Mr. <br />Husband issued a fraudulent Notice of Non-Compliance, based <br />on several similarly fraudulent inspection reports by Ernst, <br />Marrone, and Young(reference=IBLA administrative record, where <br />lies were enumerated and refuted by photos, affidavits, and <br />written testimony).
