Demand for Jury Trial:(con't) p6/9 <br />often with Orvie Zimmerman, mine owner, and with approval of <br />outgoing leasee M&MII. Partly as a result of that confrontation, <br />NOFI decided not to get involved at the Joker MIll if the BLM <br />was going to give them that kind of trouble(Ref 4,Nov 27 letter). <br />Orvie said Ernst was "acting like a wild man" and totally fright=• <br />ened and intimidated Mrs. Tuttle. <br />I ask that the jury, based on the foregoing and any <br />other information provided, recommend that both Rob Ernst and <br />his supervisor John Husband be dismissed from Federal employment <br />by filing their findings through the appropriate channels and <br />venues for such personnel actions. <br />9. Specifically with respect to the destruction of the <br />Joker MIll Oct 31,2002 to Dec. 15,2004, I request that the jury <br />find that all parties mentioned in my Nov. 27,2004 to the U.S. <br />Attorney General, be found guilty of "substantial mineral trespass" <br />in entering the Mother Lode claim(Joker) and destroying the Joker <br />Mill against the wishes of its rightful owner Orvie Zimmerman,et al. <br />Orvie tried to explain the lease terms to Ernst, but Orvie said in <br />his interview that Ernst would not listen and "just bulled his way <br />through the reclamation as it was shoved down Orvie's throat" and <br />that Earnst,threatened reprisals against his other mining property <br />The Blue Jet Mine. <br />I ask that the jury determine that the BLM return all <br />the mill equipment to Orvie Zimmerman and that they totally rebuild <br />the facility as it existed Sept 17,2001, including all ancillary <br />facilities such as water wells, tailing pond, laboratory and shop <br />buildings, and a functional mill complete with power generation, <br />and that the BLM return clear title to the Zimmerman family.
