• 2.03.7 Relationship to Areas Designated Unsuitable for Mining, <br />(1) The areas of Leases C-37210 and C-27432 were studied for <br />designation as unsuitable for mining prior to obtaining the leases in <br />May, 1984, and September, 1979, respectively. <br />Unsuitability criteria were applied to the lands of Lease C-37210 in the <br />BLM's update of the Management Framework Plan and <br />Environmental Impact Statement for Round Two of the Uinta- <br />Southwestern Utah regional coal sale. With the application of <br />exceptions to the criteria, and provided certain mitigation measures <br />were followed, the tract was considered suitable for mining (USDOI <br />BLM, 1983). <br />Based on an Environmental Analysis written on the Lease C-27432 <br />tract, the BLM concluded that the area fell under none of the <br />unsuitability criteria. A copy of the unsuitability study can be found in <br />the TE/EA Appendix, Volume 9A which contains Technical <br />Examination/Environmental Analysis done by the BLM on the Lease <br />C-27432 application. <br />r 1 <br />U <br />Unsuitability criteria were applied to the lands of Lease COC-53356 <br />in conjunction with the Uncompahgre Basin Resource Management <br />Plan (1989) and the Uinta-Southwest Utah EIS (1983). Unsuitability <br />decisions affecting the Lease COC-53356 application area were <br />reviewed and exceptions to Criteria 11 and 14, found applicable to the <br />lease C-37210 tract, were also found to apply to this tract. In addition, <br />new exceptions to Criteria No.'s 9 and 14 were found to apply to <br />Lease COC-53356. Discussion of the new exceptions found <br />applicable is presented in Environmental Analysis U-92-34 (BLM, <br />1992) completed for this tract and included in the TE/EA Appendix, <br />Volume 9A. <br />No portion of the permit area is within an area designated unsuitable <br />for underground mining under 30 CFR 764 and 765 or under further <br />study for such designation. <br />• <br />So-y <br />A fPRoVE.~ <br />9~za~a y <br />With respect to BLM unsuitability criterion #4, an area of the North <br />Fork of the Gunnison which encompasses the mine plan application <br />area has been reviewed by the BLM for potential designation as a <br />wilderness area and has been found not to have wilderness <br />characteristics. The mine plan area is no longer subject to the BLM <br />wilderness inventory and has been released from the management <br />restrictions imposed by Section 60(c) of the Federal Land Policy and <br />- 24 - Rev. 06/04 <br />
