III. COMMENTS - COMPLIANCE <br /> Colowyo C-1981-019 <br /> 20 May 2008 4�� <br /> Pg 1/5 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br /> CDRMS. The inspection was conducted on 20 and 22 May 2008 (21 May was spent <br /> inspecting the Eagle Mine). Jennifer Sekulski of CCC accompanied me on the <br /> inspection. The mine was actively mining coal and hauling coal to the loadout at <br /> the time of the inspection. The mine was also loading a train on the afternoon of 20 <br /> May 2008 while we were at the Gossard Loadout. The weather was warm and sunny <br /> on 20 May and cool and raining on 22 May. It appears as though all of the snow has <br /> melted at this time. <br /> Availability of Records: - All of the required records were available at the mine office. <br /> Please see the DRMS Availability of Records form at the end of this inspection for <br /> more detailed information. <br /> Signs and Markers: - All of the necessary signs were in place as required at the time <br /> of the inspection. Mine ID signs were in place at the main entrance and at all of the <br /> ponds along Colorado Highway 13 as required. Colowyo has a mine identification <br /> sign at the access point (by the Sturgeon house) along Colorado Highway 13, which <br /> is the access point to the Section 28 Pond. <br /> Roads: - The mine access road and haul road to the Gossard Loadout is a paved <br /> road. The road was well maintained and in good condition. <br /> - The light-use road in Taylor Draw to the West Pit Pond, East Taylor Pond was a bit <br /> rutted and wet in a few spots but it was in overall good condition. The operator was <br /> working on bading the road and cleaning the roadside ditch and was about 1/3 of <br /> the way finished. The portion of the road to the West Taylor Pond was still <br /> inaccessible approximately '/2 of the way to the pond due to a large puddle of water <br /> in a shady spot. <br /> - The haul roads in the East and West pit areas were dry on 20 May and wet and <br /> muddy on 22 May 2008. The haul roads were well maintained and appeared to be <br /> stable at the time of the inspection. No erosional problems were noted on these <br /> roads. <br /> - The light-use roads around the Gossard Loadout and to the rail loop were well <br /> maintained and in good condition at the time of the inspection. There was no major <br /> rutting evident on any of the dirt roads at Gossard. <br /> - The road to the Section 28 Pond was stable and in good condition at the time of the <br /> inspection. The operator has bladed the road and reestablished the Arizona <br /> crossings. The operator was also beginning to place the gravel surface on the road. <br /> II <br />
