Sherman <br />Executive Director <br />Dick Wolfe, P.E. <br />Director <br />RECEIVED <br />//MAY 2 3 2008 <br />Division ui meciamation, <br />mining and Safety <br />We have received your letter dated February 22, 2008 requesting renewal for the above <br />referenced plan on behalf of ACA Products, Inc. (ACA). The request has been reviewed <br />pursuant to 37-92-308(5) and you have paid the required $300 fee. Notice has been provided <br />to those on the notification list and comments have been received from Mr. James R. <br />Montgomery on behalf of the Arkansas River Outfitters Association (AROA) within the 30-day <br />comment period. <br />PLAN OPERATION <br />This plan includes an increased period of operation, anticipated aggregate production, <br />and associated depletions over the previously approved plan. These increases are attributed to <br />the reopening of the Climax Mine north of Leadville. This proposal is to run a gravel washing <br />operation beginning in late May and extending through August. You proposed to divert up to 1 <br />cfs through the Templeton Ditch off of Halfmoon Creek to fill a sediment pond and to replace <br />water lost through evaporation and aggregate export. No mining will occur at the site. <br />DEPLETIONS <br />You have estimated that the topping off of the existing pond will require up to <br />approximately 4 ac-ft, approximately 3 ac-ft for evaporation, and approximately 1 ac-ft for water <br />lost in 70,000 tons of product. The total anticipated depletions are approximately 8 ac-ft. It is <br />noted that the evaporation rates were based on those described in Upper Arkansas Water <br />Conservancy District's case no. 94CW5. Those evaporation rates included 70% of precipitation <br />resulting in a net evaporation rate. This existing pond is located off channel, and pursuant to <br />the State Engineer's Policy 2004-3, only gravel pits and on-channel reservoir can claim effective <br />precipitation.
