• BACKGROUND <br /> Mid-Continent Resources Inc. applied for and received a <br /> permit to mine coal in the State of Colorado in May of 1983 from <br /> the Colorado Mined Land Reclamation Division. Attached to this <br /> permit were two stipulations concerning backfilling, grading, <br /> drainage and reclamation procedures for the mine portal benches <br /> and haul roads in Coal Basin. These stipulations read as follows: <br /> Stipulation No. 6 <br /> The Division directs the permittee to complete a <br /> thorough geotechnical investigation and stability analysis of <br /> the proposed backf i l l ed configurations of the five portal bench- <br /> es at the Coal Basin Mines. The purpose of this project shall be <br /> to develop specific backfilling, grading and reclamation <br /> procedures to assure optimum stability of the final reclaimed <br /> portal benches. <br /> Further, the permittee shall prepare a detailed mater- <br /> ial balance, designating the proposed source of materials to be <br /> utilized in completing the backfilling and grading of the mine <br /> portal areas. <br /> The permittee shall submit the report of geotechnical <br /> investigation and stability analysis, the detailed material <br /> balance and a detailed portal bench reclamation plan to the <br /> Division following the schedule on page 21.2 of Chapter V, Vol- <br /> ume V of the permit application. <br /> Stipulation No. 8 <br /> The Division directs the permittee to complete a <br /> thorough mapping of the existing haul road system at the Coal <br /> Basin Mines. This mapping shall include topics such as bedrock <br /> and surface geology, exposure to landsliding and avalanching, <br /> method of road construction (cut versus fill ) , and original <br /> cross-slope angles, at a minimum. The purpose of this <br /> reconnaissance and mapping program shall be to categorize the <br /> existing haul road system, in order to allow the development of <br /> typical reclamation procedures for each category of road. The <br /> permittee shall complete this mapping and categorization and <br /> submit maps and accompanying report to the Division for review <br /> prior to December 319 1983. <br /> Further, the permittee shall prepare a detailed material <br /> balance, designating the proposed source of materials to be <br /> utilized in completing the backfilling and goading of the haul <br /> road system. The permittee shall also propose specific backfill , <br /> grading, drainage, and reclamation procedures- to assure optimum <br /> stability of the final reduced haul road configuration. The <br />
