Issues related to state highway access and traffic are regulated by the Colorado Department of
Transportation and do not fall under the jurisdiction the Division of Reclamation, Mining, and Safety.

Issues related to land use and the resulting impacts to property values are regulated by Montezuma and
not the Division of Reclamation, Mining, and Safety.
III. DIVISION RECOMMENDATION
It is the Division's determination that the Applicant has fulfilled all of the minimum requirements for
approval of the proposed permit for the Mud Creek Pit permit M-2008-010. Therefore the Division
recommends approval of the permit.
