Traffic <br />• The letters from Nancy Segal and Catherine Neva and Debra Cross voices concerns related to <br />traffic and access onto Colorado State Hwy 160. <br />Division Response <br />Issues related to state highway access and traffic are regulated by the Colorado Department of <br />Transportation and do not fall under the jurisdiction the Division of Reclamation, Mining, and Safety. <br />4. Property value <br />• The letter from Catherine Neva and Debra Cross voices concerns related to impacts to property <br />values in the area related to the proposed activity at the site. <br />Division Response <br />Issues related to land use and the resulting impacts to property values are regulated by Montezuma and <br />not the Division of Reclamation, Mining, and Safety. <br />III. DIVISION RECOMMENDATION <br />It is the Division's determination that the Applicant has fulfilled all of the minimum requirements for <br />approval of the proposed permit for the Mud Creek Pit permit M-2008-010. Therefore the Division <br />recommends approval of the permit. <br />4
