Notice to Parties and Interested Persons to the Mud Creek Pit Permit Application
RE: Pre-hearing Conference and Formal Public Hearing for
Mud Creek Pit, Permit No. M-2008-010.

The Colorado Division of Reclamation, Mining, and Safety (DRMS) has received objections to the
amendment application for the Mud Creek Pit.
Therefore, staff has scheduled the matter for Formal Public Hearing before the Colorado Mined Land
Reclamation Board, for consideration. The hearing for consideration of the Mud Creek Pit permit will
occur during the June 11 & 12, 2008 Board meeting at Centennial Building, 1313 Sherman Street,
Room 318, Denver, Colorado 80203, commencing at 9:00 a.m. or as soon thereafter as the matter can
be considered on June 11 or 9:00 a.m. or as soon thereafter as the matter can be considered on June
12. Parties and interested persons will have the opportunity to be heard.
A Pre-hearing Conference has been scheduled to occur on May 29, 2008, beginning at 2:00 p.m. Ms.
Sandra Brown will preside as Pre-hearing Conference Officer.
In order to participate in the teleconference, perform the following steps, at or just before the scheduled
conference time and date:
1. Dial the toll free, Conferencing access number 1 [phone]
2. Dial the Conferencing "room" number * 2977618 * (NOTE: the star key must be pressed before
and after the room number).
3. Wait to be added to the conference.
Failure to participate in the Prehearing Conference will result in the loss of your party status. If you
experience any difficulty in connecting to the teleconference, please contact the reception desk at the
Division's Denver Office at [phone].
The purpose of the Pre-hearing Conference is to describe the Office's review process, to explain the
rights and responsibilities of parties, to discuss and resolve issues to the extent possible, to describe
the Board Hearing processes, to determine the list of issues under the Board's jurisdiction and to
simplify the list, and to determine who has demonstrated standing to be a party to the Formal Board
Hearing.
After the conference, the Pre-hearing Conference Officer shall cause to be drafted a Pre-hearing Order.
The Pre-hearing Order will be mailed to all parties within 10 working days after the conference and will
contain a list of the parties, provide a recommended list of issues to be considered by the Board, and
outline a schedule for the hearing with time allotments set for presentations by each party and the
Office. The conditions of the Pre-hearing Order are not final until adopted or approved by the Board at
