Mr. Dan Mathews
Division of Reclamation, Mining and Safety
Page 2
Following is a tabulation of the events prior to the date of the violation with the measured flows:
Exceedence Flume Depth Ora cfs
9/4/07 0.445 644 1.435
9/17/07 >1.50 >4206 >9.37
10/2/07 0.365 474 1.056
4/16/08 0.975 2163 4.82
4/18/08 0.450 655 1.459
4/19/08 1.371 3656 8.146
4/20/08 1.335 3513 7.823
4/21/08 0.665 1198 2.669
4/22/08 1.31 3412 7.602
Attached are records from the Hayden Weather Station aspmduced by the Colorado Climate Centerpmzided as
backup for the SCC records
The compounded runoff plus the associated slide has resulted in excess sedimentation in Pond 012. Even
with the extordinary runoff last fall and this spring and the associated slide, Pond 012 is just barely under
required water capacity.
On Wednesday, May 21St, a certified geotechnical engineer (Brian Len P.E., NWCQ was on site to observe the
situation related to the Pond 012 slide. SCC will receive a proposed evaluation plan from Mr. Len, which will
in turn be submitted to DRMS not later than June 15, 2008. The DRMS should note that equipment cannot
access the area until the area has dried out significantly. Therefore Step 3, "completion of any remedial
control measures", will not be possible by July 15, 2008.
Attached are 2 (two) copies of the current Pond 012 configuration, a CSV table of the surveyed points, and
copies of the relevant precipitation data from the Hayden weather station. A third copy has been sent to the
Denver office also addressed to you. This submittal meets the Step 1 abatement requirements.
Sincerely,
4r
.2
Roy A.
