III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator during the field inspection and records check.During the field inspection,many sheep were grazing on <br /> the reclaimed slopes of the mine. The general area received a fair amount of precipitation in the last few days. <br /> Roads <br /> The Hubbard Creek road was in very good condition,considering the recent precipitation. The road across <br /> Hubbard Creek to the mine site entrance was also in good condition. The light use road to pond five was a little <br /> wet from precipitation and roughened up due to the sheep. <br /> Signs and Markers <br /> The mine ID sign was up on the entrance gate, which was closed and locked. Also on the gate was the"records <br /> location"sign. Surface disturbance markers were up around the disturbed area. <br /> Hydrology <br /> Pond 4 was completely dry. The pond embankment was well vegetated and appeared to be stable. The pond 4 <br /> spillways were functional. The inlet of the road culvert leading from the reclaimed coal stockpile area to pond 4 <br /> had been recently cleaned out.The upland diversion ditch in this area was well grassed and had sufficient <br /> capacity. <br /> There was a little water in pond 5. The spillways of pond 5 were functional. The collection ditch leading into <br /> pond 5 had a good vegetative cover and had sufficient capacity as well. <br /> Hubbard Creek was running high. The creek culvert under the entrance road was clear of debris. <br /> Reclamation <br /> There was no evidence of any slumping or erosional problems with the reclaimed mine hillside. The reclaimed <br /> hillside had a good vegetative cover, although, as mentioned before,there were many grazing sheep there. Small <br /> seeps were evident on the hillside. <br /> There was a good vegetative cover at the reclaimed coal stockpile area.However,the sheep had been grazing <br /> there as well because all of the grass was uniformly short. <br /> The reclaimed haul road appeared to be stable, with no erosional or stability problems <br /> Records <br /> The records are located in the vault at the Delta County Clerk's Office in Delta.The records were in <br /> compliance, as shown on the following records checklist. <br /> c:/word/bl ueribbon/insp05O8 <br />
