III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator during the field inspection and records check.The day was very overcast and cold with a very slight <br /> sprinkle. The entire loadout area was wet. <br /> Facilities <br /> There was a small volume of coal that was stockpiled on the facilities bench. One coal haul truck was seen <br /> unloading and coal railcars were being loaded during the field inspection.No problems with fugitive dust were <br /> observed. The facilities bench berm was in place.There were no problems noted at the office, shop area, <br /> substation,material storage area,weigh station,haul truck unloading structure and railcar loading structures. <br /> There were no leaks at the fuel facility. <br /> Roads <br /> The entrance road was in good condition,with the guard rail in place. There was no debris or coal fines on the <br /> entrance road and no coal fines had been tracked onto the highway. The graveled east entrance road was also in <br /> good condition. The light use road along the railroad tracks was wet but passable. <br /> Hydrology <br /> The dugout pond did not have any standing water in it.There was standing water in the east pond but the water <br /> level was about three feet below the primary discharge pipe invert. The gated valve of the primary pipe was <br /> closed. The pond embankment was well vegetated and the emergency spillway was functional. <br /> All of the culverts were clear and the loadout ditches had sufficient capacity. The straw bales and silt fence that <br /> act as the sediment control for the railroad track small area exemption were in place. <br /> Topsoil <br /> Both the east topsoil stockpile and the west topsoil stockpile were well vegetated.Collection and diversion <br /> ditches/berms for the two stockpiles were in place. Topsoil signs were up on both topsoil stockpiles. <br /> Weed Mana eg ment <br /> The operator is planning on bringing in a weed sprayer for the loadout area. Some whitetop was coming up on <br /> the south side of the west topsoil stockpile area. <br /> Sims and Markers <br /> Permit area boundary markers were up.Mine ID signs were up at the main entrance,east entrance and near the <br /> railroad crossing. The required loadout information was on each sign. <br /> Records <br /> All of the required loadout records were at the loadout office.
