XII. Post-Mining Land Use <br />A. The Division is proposing to approve a post-mining land use of irrigated cropland. The land <br />use meets the criteria of Rule 4.16.3. <br />XIII. Protection of Fish, Wildlife, and Related Environmental Values <br />A. The applicant has proposed the use of persistent pesticides to the site during operation and <br />reclamation activities at the site. <br />There is a plan in place to deal with noxious weeds, particularly white top, that appear at the <br />Terror Creek Loadout. TCC will maintain records of herbicide use on the property for <br />inspection by Division personnel. <br />XIV. Protection of Underground Mining <br />A. There are no current or proposed surface mining operations within or next to the Terror Creek <br />Loadout. <br />XV. Subsidence Control <br />A. This section does not apply to this operation, as Terror Creek is a loadout. No mining has <br />occurred or will occur. <br />XVI. Concurrent Surface and Underground Mining <br />A. This section does not apply to the Terror Creek Loadout. <br />XVII. Operations on Alluvial Valley Floors <br />Identification of Alluvial Valley Floors <br />A. Terror Creek Company has identified an alluvial deposit extending approximately one mile to <br />the east (upstream) and three miles to the southwest (downstream) ofthe permit area along the <br />North Fork of the Gunnison River (Map 2). Lands upstream from the permit area are not a <br />part of the hydrologic system that could be affected by the Terror Creek operation; therefore, <br />no determination will be made by the Division for those lands at this time. <br />The valley bottom complex in the immediate vicinity of the proposed permit area (i.e., <br />sections 15 and 22) consists of the current flood plain of the North Fork of the Gunnison and <br />a sloping colluvial deposit which rises above the flood plain to the north. Cropland, primarily <br />fruit orchards and hay land, exists on both the colluvium and the flood plain in the vicinity <br />and is irrigated with water diverted from the Deer Trail Ditch which roughly parallels State <br />Highway 133 along the northern border of the proposed permit area. <br />Detailed site geology (Map 11) and land use information (Map 4) provided within the <br />application with regard to the colluvial deposit is limited to an area extending approximately <br />1,500 feet in all directions from the proposed permit boundary. An evaluation ofthe colluvial <br />deposit with respect to alluvial valley floor inclusion will be limited to that portion of the <br />deposit mapped as Qc (unconsolidated colluvium) on Map 11. <br />17
