Listed below is the additional information we <br />require in order to process the application. <br />Be advised that the applicant must provide the required information in time for the Division to review and <br />provide a recommendation for approval or denial to the Mined Land Reclamation Board by Tuesday, May <br />27, 2008 (three working days prior to the pre-hearing conference, per Rule 1.4.9(2)(c).). If the required <br />information is not provided within that timeframe, the Division will be forced to recommend to the Board <br />that the application be denied. <br />Rule 3.1.6 Water - General Requirements <br />I ) For your clarification, DBMS does not consider it necessary to abandon the 12-foot deep well, as cross- <br />communication between aquifers should not be a concern for such a shallow completion. Therefore, <br />simply removing the well will suffice. Additionally, it the integrity of the deeper wells is not <br />compromised by mining activities, then simply mining around the deeper wells would be adequate in <br />lieu of abandonment. <br />2) Applicant has provided no technical data to back up the statement that there will be no major impacts to <br />the ground water system. Aquifer tests can be performed to assess aquifer characteristics, and lacking <br />data for future fill material, estimates can be made of hydraulic conductivity.
