The DMR is required to be submitted under Colorado <br />Discharge Permit System (CDPS) Permit Number CO-0047562 and to be copied to you <br />in accordance with a stipulation in the Bureau of Land Management (BLM) approval <br />letter for Energy Fuels Prospecting Permit Notice of Intent (NOI) Modification 2, dated <br />September 10, 2007. Note that there are two exceedances of the effluent limitations, both <br />for total suspended solids (TSS). I've included the non-compliance notification letter <br />Energy Fuels provided to the Colorado Department of Public Health and Environment as <br />well as the laboratory data for the three sampling events that took place in March 2008. <br />Preliminary analytical data for the only sample event that took place in April 2008 <br />indicates that the water discharge will be in compliance with the permit for TSS. <br />Attached with this letter is the third party sampling event analytical results from the <br />March 25, 2008 sampling event. The sampling was performed by Western Water & <br />Land, Inc. and the analyses by Grand Junction Laboratories. These analytical results are <br />generally consistent with the analytical results for the samples collected by Energy Fuels <br />and analyzed by Energy Laboratories. <br />Western Water and Land, Inc. has provided third party sampling of the treatment plant <br />discharge on April 23, 2008 per the stipulation in the 9/10/08 BLM approval letter. We <br />have not received the analytical results from the third party laboratory for this sampling <br />event. We will provide these results to you when they are available. As discussed in <br />previous conversations with you, Energy Fuels will be using ACZ Laboratories for third <br />party analysis beginning with the April 23 sampling event.
