III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The,comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division) on 12 May 2008. The weather was cloudy during the on- <br /> the-ground inspection of the site. There continues to be snow cover on the north facing area of the <br /> mine site and access to the entire mine site was limited. Access to the site was achieved on foot. <br /> Availability of Records <br /> See attached DRMS Availability of Records. All records were located at the Routt County Courthouse <br /> in Steamboat Springs, CO. <br /> Signs and Markers <br /> The mine I.D. signs were in place at the entrance of the Old Tipple Road entering the mine area to the <br /> south, the road off of County Road 78 and the North Road entering the mine area from the north. All <br /> mine I.D. signs appeared to be in compliance with no problems noted. <br /> Roads <br /> The Old Tipple Road, North Road, Lower Moffat Road, Center Ridge Pond Road, West Ridge Pond <br /> Road, and West Ridge Road continue to have patches of snow cover on their east sides. Portions of <br /> the North Road was traversed on foot during the inspection, and appeared to be stable with no <br /> problems noted. All roads appeared to be stable and in compliance with no problems noted at the <br /> time of the inspection. <br /> Hydrologic Balance <br /> The Moffat Pond was full of water with a high amount of discharge noted. The embankments <br /> appeared to be stable and well vegetated with no problems noted. The primary spillway appeared to <br /> be functioning as permitted and the emergency spillway appeared to be in compliance with no <br /> problems noted. <br /> The Center Ridge pond was full of water and discharging at the time of the inspection. The <br /> embankments appeared stable and in compliance at the time of the inspection the primary spillway <br /> was functioning as permitted and the emergency spillway was in good condition with no problems <br /> noted. <br /> The West Ridge Pond was full of water and discharging at the time of the inspection. The lower <br /> portion of the West Ridge Pond was holding water at the time of the inspection. The embankments <br /> appeared stable with no problems noted. The primary spillway was functioning as permitted at the <br /> time of the inspection. <br /> The permanent diversion ditch from the West Ridge Pond to the Center Ridge Pond contained water <br /> and was discharging with the Center Ridge Pond. The Flume located between the Center Ridge Pond <br /> and the river was flowing at 1.2 cfs. <br /> The four Moffat down drains appeared to be in good condition with no problems noted. No water was <br /> observed flowing in the drains at the time of the inspections. <br /> The string-of-pearls permanent drainage channel contained water at the check dams. No problems <br /> were noted and the drainage appears to be functioning as designed. <br /> it <br />
