III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Comments <br /> This was an aerial inspection of McClane Canyon Mine. The flight was on 4/22/08. Harry Ranney of DRMS <br /> recorded 4 near-vertical and oblique digital images. Imagery covered the entire disturbed area in McClane <br /> Canyon,from the portal area down to Highway 139. The site was completely free of snow at the time of the flight. <br /> Coal was being loaded from the stockpile onto highway trucks for transport to market. Construction associated <br /> with the approved expansion of the high ash coal/sediment cleanings stockpile, near the sediment pond was in <br /> progress. It was evident that topsoil salvaged from the expansion area had been placed on the topsoil stockpile. <br /> Water was pooled in the sediment pond and in the"in ditch" sediment sump east of the sediment pond. <br /> Disturbed area drainage appeared to be properly contained within the approved sediment collection system <br /> (sediment pond, plus silt fence SAE installations at the topsoil stockpile, construction material stockpile, and <br /> office area). <br /> McClane Creek was dry at the time of the flight; there was turbid flow in East Salt Creek. <br /> No problems were evident. <br /> 3 <br />
