Cottony <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Mud Creek Pit .l 12(c) Permit Application, File No. M-2008- <br />010. The recommendation date for this permit application is May 23, 2008. The Division of Reclamation, <br />Mining, and Safety (Division) is required to make a recommendation by May 23, 2008. Therefore, your response <br />to the following adequacy review concerns should be submitted to the Division as soon as possible. <br />As required by Rule 1.6.5 (2), please submit the proof of notice to all owners of record of surface lands and <br />easement holders that are on the affected land and within 200 feet of the boundary of the affected land. Proof <br />of notice may be return receipts of a Certified Mailing or by proof of personal service. <br />Although proof of publication was supplied by McStone Aggregates, the proofs of notice identified as <br />Attachment 2 in the .adequacy response letter were not included with the response. Please supply these <br />notices. <br />Rule 6 4.4 Exhibit D -Mining Plan <br />2. Section 3.1.6(1), referred to the in the previous adequacy letter, relates to Section 3.1.6(1) of the Rules and <br />Regulations, not the Mining Planr <br />With regard to the topsoil that will be reserved at the site, the soil that is salvaged should consist only of the <br />collide complex. It covers the vast majority of the portions of the site to be affected and is by far the better <br />soil for revegetation. For non-irrigated areas, 12 inches is an adequate replacement depth. For irrigated <br />pasture, an 18 inch minimum replacement depth is necessary to minimize loss of irrigation water and <br />maximize productivity of revegetation. In .the materials submitted, the proposed stockpile for processing area <br />A is slated to hold 10,000 c.y. It will take 13,000+ c.y. to replace a foot of soil over this area: Additionally, <br />reclamation is proposed for the!, bar ditches of the roads. Adequate salvaged topsoil will be necessary to <br />reclaim and stabilize any cut and, fill slopes along the road. ,Prior to sale of any topsoil, a soil balance should <br />be conducted between the proposed stockpile amounts and the proposed replacement amounts to ensure <br />adequate topsoil will be salvaged. The submitted application proposes to add soil amendments and also <br />proposes use of sediment pond cleanings and processing fines for topsoil. A revision to the permit will need <br />to be submitted, or a revision" to this application, to incorporate specifics of the use of proposed soil <br />amendments. The best timing for this is after soil analysis is done at the time of reclamation. The use of fines <br />or sediment is generally only done when adequate topsoil resource is not available for salvage.
