On page 8 Denison requests that the Division approve an extension to one year, for submittal of the EPP, in <br />order that there may be sufficient time for geochemical characterization. The Division accepts benison's steps <br />contained in the two-phased approach toward preparing the EPPs and interim submittals toward subsequent <br />DMO determinations, and also approves benison's request for this extension to one year. Prior to one year <br />Denison must present a summary of progress being made toward each EPP, for each permit that still does not <br />have a final DM0 determination made. These reports should include which parts of the EPP are lacking, how <br />many quarters of water sampling remain, and any other tests whose results are still pending. The Division also <br />accepts benison's statement that the three 112 sites are sufficiently similar to allow preparation and submittal of <br />one single EPP for the three 112 permitted sites. <br />This letter of response to Denison discusses the Memo dated March 31, 2008. That Memo appeared to be <br />identified as a Draft version. Will Denison revise and provide a final version of the Memo, in order. to provide <br />commitments or answers related to the sampling or the EPP? It appears that most, if not all, of the issues raised <br />by Denison are sufficiently addressed and that the plans and sampling may commence. It is not clear what the <br />framework of benison's response may be, nor what level of review or discussion this office must undertake, but <br />we will endeavor to ensure that we respond promptly in order that your activities may begin soon. <br />This office appreciates the depth and quality of the Memo's content.
