MINE ID # OR PROSPECTING ID # M-1988-090 INSPECTION DATE 04/24/2008 INSPECTOR'S INITIALS DEZ The following problems (PB) and/or possible violations (PV) (and suggested corrective actions) were identified during this inspection. The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS CORRECTION DATE ~1. Mine entrance sign and permit boundary markers were not clearly posted per Rule 3.1.12(2) and Rule 7/ 30/ 2008 3.1.12(2) (1)(c) which require the operator to clearly label the mine entrance and permit boundaries. CORRECTIVE ACTION: The operator shall clearly mark the mine entrance and permit boundaries and submit photographic evidence of this on or before Julv 30, 2008. Improper storage and containment of fuels and/or other hazardous materials was found on site. CORRECTIVE ACTION: All storage tanks. petroleum and anv hazardous materials on site for anv period of time shall have secondary containment. Please supply photo documentation that the fuel tank and anv additional containers are stored in a proper secondary containment structure on or before July 30, 2008. This secondary containment structure shall include a berm that contains all contents of the tank and various containers (when full) plus 10% of the containers' capacity. and an impermeable liner. Or provide photo documentation that all containers have been removed from the site on or before Julv 30, 2008. 3. The range of debris on the mine site such as concrete, tires, rusted metal, and old appliances stockpiled on~mine site must be removed per C.R.S. 34-32.5-116(4)(e) which states that "all refuse shall be disposed of in a manner that controls unsightliness or the deleterious effects of such refuse." CORRECTIVE ACTION: The rusted metal debris must be removed and photos~raphic evidence of compliance must be received by the Division on or before July 30. 2008. 4•~ Russian Olive was observed in several small sections in the pits. CORRECTIVE ACTION: IThe Operator must submit to the Division on or before July 30, 2008 either a letter committing the Operator to addressing the Russian Olive problem during reclamation (while regrading the site) or a weed control and management plan per Rule 3.1.10(6). If the weed control and management plan is the option chosen then the plan shall be developed in consultation with the county extension agency or weed control district office and shall include specific control measures to be applied, a schedule of when the control measures will be applied, along with apost-spray monitoring plan. 5. ,Groundwater appears to have been exposed on site without prior approval by the Office of the State Engineer and submittal of an approved substitute water supply plan No mention of groundwater exposure was made in the approved reclamation plan. CORRECTIVE ACTION: Please clarify the origin of the water and, if it is s~roundwater, fill_in the area, cover it with a minimum 2 PB or PV: PB TOPIC(S): SM 7/ 30/ 2008 PB or PV: PB TOPIC(S): AT 7 ~ 30~ 2008 PB or PV: PB TOPIC(S): RS 7/ 30/ 2008 PB or PV: PB TOPIC(S): RV 7 ~ 30~ 2008 PB or PV: PB TOPIC(S): HB (two) feet of material above the highest groundwater elevation, and submit photographic documentation of this corrective action to DRMS on or before July 30, 2008. Or the operator shall submit a substitute water supply plan and begin the process of obtaining endorsement from the Office of State Engineer (OSE) for this exposure on or before July 30, 2008.
