Permittee wishes to assign the permit to <br />GCC Energy, LLC <br />address <br />_ 11783 Highway 337, Tijeras, NM 87059 , as Successar <br />t)perator ("Successor") and Successor wishes to becomt; Successor Pernittee under the permit. <br />C. Successar understands that the reclarnatian plan (the ``t'tan"j required by the permit and by appiicabie <br />State laws and regulations has not been completed and is willing to assume full responsibility for the <br />cotmpletian of~the Plan. <br /> <br />Pertnitiee and Successor hereby agree, f`or their awrl benefit and far the benefit af` the State, such <br />agreements to be effective ipso i'acta upon the approval by the State of the transfer of the Permit tram <br />Permrttee to Successar. as follows: <br />1. Successar has inspected the mining and reclamation operatiotls to its entire satisfaction and is <br />fully aware of the condition thereof: Suct;essc>r understands and accepts alt of the conditions of the t'ermit. <br />?. Successor «~ill ct~tltplete the reclarnatian plan, and hereby assumes liability f'ar completing <br />such plan a_5 to aJl areas heretofore: disturbed, as well as to all areas hereafter disturbed.
