of use related to places of refuse disposal, haul roads and road cuts. All applicable industry <br />stabilization standards for such areas will be used. The Orator/Applicant is aware that no <br />planting is required on these areas, as follows: <br />(a) On any affected land being used or proposed for the deposit or disposal of refuse until <br />after the cessation of operations for productive use of such refuse. <br />(b) On lands proposed for future mining. <br />(c) Within depressed haulage roads or final cuts while such roads or final cuts are being <br />used or made. <br />(d) Where permanent pools or lakes have been formed. <br />(e) On any affected land so long as the chemical and physical characteristics of the <br />surface and immediately underlying materials of such affected land are toxic, deficient in <br />plant nutrients, or composed of sand, gravel, and cannot feasibly be remedied by chemical <br />treatment, fertilization, replacement of overburden, or like measures. <br />(9) Adverse characteristics of the surface and the substitution of alternative areas: <br />The Operator/Applicant understands that where adverse characteristics of the surface <br />exist, and it is not feasible to remedy by artificial measures, that substitute acres may be <br />reclaimed. <br />3.1.11 Buildings and Structures: <br />The site is privately awned surface and the minerals is appurtenance to the land. The site <br />does not fall under the State Historic Preservation Office Requirements for a cultural or <br />historical study. Certain structures and buildings related to the post mining land use, <br />developed water resource, will be required for its proper functioning and will therefore be <br />left as part of the post mining land use. These buildings and structures will comply with <br />applicable local building codes and ordinances. <br />3.1,12 Signs and Markers: <br />(1) Facility entrance sign: The OperatorlApplicant will post a sign, clearly visible <br />from one of the points of access (One of the three access roads) with the following <br />information: <br />(a) Operator's name. <br />(b) A statement that the reclamation permit for the operation has been issued by the <br />Colorado Mined Land Reclamation Board. <br />(c) The permit number issued for the MLRB permit. <br />
