B) To answer the Division's question about the post mining reclamation. <br />Response: The applicant will reclaim the lands not inundated by the water that will be stored in <br />the reservoirs as Rangeland/Wildlife as stated in the reclamation plan. The intent is to have areas <br />not covered by the lake as post mining land asRange/Wild Life Habitat. The local permit does <br />allow for one asphalt hot-mix plant and one concrete batch plant all other areas will be reclaim as <br />rangeland/wild life habitat. <br />C) "It is the understanding of the Division that the Applicant has committed to slope angles <br />3:1 or gentler. However the Division normally recommend the first 10 feet of the slope angles <br />that will be under water to even be gentler than 3:1 slope." <br />Response: The proposed structure will not be steeper than 3H:1 V for the f rst 10 feet of depth. <br />The proposed facility is a water storage reservoir and as such the slope angles are intended to <br />maximize water storage and ensure slope stability. <br />D) "The applicant states, `all the material excavated as part of the Excelsior Ditch relocation, <br />will either be used for permanent visual berm and/or construction of earthen dams (dependent on <br />the quality of the material for such construction.' In order for DRMS to calculate the required <br />warranty for removal and transport of such items, we will need the estimated size and location of <br />the proposed stockpile. In addition, please show locations of all top soil/overburden stockpiles in <br />the reclamation map. The applicant has stated that all stockpiles will be placed outside of the <br />100 year124 hour Flood Plain Area. In the map, please indicate the extent of the 100 year/24 <br />hour flood plain area." <br />Response: The topsoil is stockpiled north of the flood plain shown on the mining plan map dated <br />11/14/07. The topsail will be used for revegetation and it will not remain as shown on the mining <br />plan map. All of the over burden will either be used in the production of product or used in the <br />construction of the reservoirs. No visual berms are planned. <br />It is the desire of the Applicant to sell as much excess material as possible over what will be <br />needed for site reclamation and dam facilities construction. The 100-year flood plain is shown on <br />the pre-mining and both of the mining plans maps shown as a black dotted line. Product <br />stockpiles will be located an the north side of the flood plain zone and overburden will be stared <br />on both sides of the flood plain zone. The overburden on both the south and north sides of the <br />floodplain zone will be used for slurry wall construction, therefore it will only be placed <br />temporarily as shown on the maps until it is consumed in the construction of the slurry wall <br />mixture. The topsoil stockpiles will be on the northern boundary of both pits until it is used to <br />revegetate the lands around the lakes and all areas that need to be seeded. <br />
