Dear Ms. Pickford: Thank you for your letter of 11 April 2008 and your time on 24 April 2008. We are providing the response to the letter in the same twelve points as included in your letter. A thirteenth item was added to provide information based on Mr. Barton's conversation with you. We believe that we have fully answered all questions in accordance with the Mineral Rules and Regulations. A copy of this letter and the attachments will be placed with the copies on file with the County and available at the County Clerk's Office. Attachment 1 is an errata sheet with various corrections of typos and incorrect references, some of which are referred to in various items. Proof of Publication: At Attachment 2 are the affidavit of publication and the receipts for delivery of notices to the persons as required. Please note that the Operator IS the owner of record of surface lands, as identified in Exhibits N and O. We believe that we have complied with all requirements for public notice. 2. Map C-3 references. Please accept our apologies: all references to "Map C-3" on Exhibit pages 9, 10, and 11 should be references to "Map C-2." In addition, two references to "Map C-2" in the first bullet of Section D-2 on page 9 should refer to "Map C-1 ." We believe that we have provided all information as required and referenced in the application and Exhibits. 3. Hazardous materials We have reviewed the entire application extensively and run searches on both the original Word version and on the Adobe PDF document, and have been unable to find any place in the "Mining Plan" and "Reclamation Plan" or anywhere else in the document where we made
