IV. ENFORCEMENT ACTIONS <br /> The following identifies enforcement actions taken during this inspection, the required abatement and date of <br /> abatement for the violation, previous violations still requiring abatement and the termination of violations cited <br /> during previous inspections. <br /> NOV CV-2008-001 Abatement Steps and Dates <br /> Step 1: No later than May 30, 2008, provide a P.E. certified report documenting the storage capacity in <br /> Pond 12, and demonstrating whether the pond capacity is adequate to treat the design storm <br /> event runoff in compliance with applicable requirements of 4.05.1, 4.05.2, and 4.05.6. If the <br /> certified report indicates that Pond 12 capacity is not adequate, the report will address measures <br /> to be implemented to ensure that adequate sediment controls are in place in the Pond 12 <br /> watershed, to ensure compliance with sedimentation effluent limits of 4.05.1, 4.05.2, and <br /> 4.05.6. Such measures may include clean out of Pond 12 and/or construction of Pond 12A <br /> and/or other measures as warranted. <br /> Step 2: No later than June 15, 2008, provide a slide remediation technical revision application to <br /> amend or supplement Permit Attachment 13-12 B. The remedial plan shall be prepared by a <br /> qualified geotechnical engineer, shall identify and assess the factors that contributed to the <br /> failure, shall include specific remedial measures to be implemented to repair the slide and effect <br /> compliance with applicable requirements of Rule 4.14, and shall include a geotechnical <br /> stability analysis demonstrating that that the remedial plan will result in a final slope that will <br /> comply with Rule 4.14.2(1)(b). <br /> Step 3: Any remedial sediment control measures identified in the report specified in Abatement Step 1, <br /> or required by the Division following review of the report, will be implemented and completed <br /> no later than July 15, 2008. <br /> NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br /> Revised 2/97 <br /> 12 <br />
