Letter of Objection and Protest: M2008006 <br />May 1, 2008 <br />subdivisions of Ridge West, Bison Ridge, High Pointe Estates and Steeplechase. <br />It is an area with significant population of all ages that enjoy a quality of life. The <br />Frank State Wildlife Area is northeast of the River West subdivision. River West <br />was established in approximately 1999. The property of the proposed mining <br />operation was purchased by SerFer Land Ventures LLC in 2006. <br />COMMENTS <br />Comment One: The application should be denied in total. The location of the <br />proposed mining operation is inappropriately close and/or adjacent to previously <br />developed residential areas of significant population, the Cache la Poudre River, <br />the Poudre River Trail, the Frank State Wildlife Area and environmentally <br />sensitive areas. We maintain the proposed operation presents significant <br />dangers to the health, safety, child welfare, environment, property values, <br />aesthetics and quality of life for ourselves and other residents in the area. <br />Comment Two, _Traffic: The proposed operation would significantly increase <br />commercial traffic and construction traffic, which is already an issue of serious <br />concern, along CR 13 and Hwy 392. CR 13 is the only access to the <br />subdivisions of River West, Ridge West, High Pointe Estates, Bison Ridge and <br />individual residences as well as the wildlife and public access areas. It is partial <br />access for residents of Steeplechase. Further, CR 13 is on numerous school bus <br />routes. Related issues such as stop lights, acceleration and deceleration lanes, <br />bike paths, additional parking for public areas, restricted truck traffic, restricted <br />southbound CR 13 truck use, material spillage, compression brake usage and <br />speed limits must be addressed. <br />Comment Three, Noise: The proposed operation would offensively increase <br />noise levels in the neighboring areas. Days and hours of operation should be <br />severely limited. Processing of material on site should be forbidden. Mined <br />materials should be required to be removed from the site in the wet stage. In the <br />event some processing is permitted, it should be restricted to sorting of the <br />materials only. In the event crushing of the material on site is permitted, the <br />crusher should be required to be located in the pit itself and the noise abated with <br />shields. <br />Comment Four, Flood Plain: The proposed operation is completely whin the <br />floodplain and therefore has the potential to cause interruption to the flow of flood <br />waters. We are concerned that interruption of the flood plain can cause serious <br />risk to our property and the property of our neighbors and subdivision as well as <br />the health and safety of everyone. Appropriate studies should be completed and <br />guidelines instituted to insure the sanctity of the Flood Plain and safe conditions <br />during a flood event. <br />Comment Five Dust Airborne Particulate Matter and Air Pollution: The <br />proposed operation has the capability of sign~cantly increasing the dust, <br />2 <br />
