o Regarding revegetation the report states:
Vegetation is outstanding due to excellent
rainfall and growing conditions.
o Vegetation is good in all areas (of the
reclaimed loadout area) with only isolated
areas of kochia and cheatgrass noted. Both
ponds at the loadout were dry and have
nearly 100% capacity remaining for runoff
and/or sediment. Overall, the area appeared
in excellent condition for the summer season.
o No enforcement actions were taken as a
result of this inspection and none are
currently pending.
- SUMMARY
Due process is to assure fair procedure. The process of notification
to we, the property owners was inadequate and inefficient. Without
sufficient notice or cause, we were not assured fair procedure with
regards to the hearing on March 11, 2008.
My brother Theodore A. Coulter will be in Colorado the week of May
11, 2008 and we are requesting a hearing at your May 13, 2008
meeting. Linda DeFillippie Saunders will also be in attendance. It is
important to schedule a meeting in a timely fashion as the original
permit expires May 14, 2008.
I look forward to your reply and thank you for your time with this matter.
Sincerely,
Paula Coulter
1041 Field Street
Lakewood, CO 80215
303 238-9197
cc: Energy Fuels Coal, Inc.
Colorado Division of Reclamation Mining and Safety
Theodore Coulter
Linda DeFillippie Saunders
Tena DeFillippie Gallagher
4
