routinely uses this area for staging of large tractor trailers, earth-moving equipment, pipeline, and <br />large gas compressors and associated parts. Timber trucks also frequently use this area. <br />Observations of the Division <br />Coal bed methane extraction activities continue at a fast pace on the greater Lorencito property. <br />In addition, gravel extraction activities have occurred in and adjacent to disturbed areas of the <br />coal loadout. Equipment parking is common at both the loadout and the office area. Roads <br />leading to the reclaimed area of the surface mine are used daily, primarily by gas company <br />vehicles. There is no question that the industrial activities have commenced and in fact have <br />been ongoing throughout the entire mining period. <br />Hydrologic impacts have not been identified for these areas through the on-going hydrologic <br />monitoring plan and no impacts are anticipated. Areas subject to vehicle travel are adequately <br />surfaced with gravel and are routinely maintained by the gas operator. Drainage of road runoff is <br />adequate using ditch relief drains and culverts with protected drainage outlets as necessary. Road <br />outslopes along permanent roadways and berm areas at the coal loadout have been reseeded and <br />revegetated in accordance with the Rules and as required for industrial land use areas. <br />In conclusion, any issues identified through the bond release process have been resolved or <br />completed as necessary. At this time, there are no outstanding issues or problems that would <br />preclude approval of this Industrial Land Use bond release for 27.2 acres of disturbed lands of <br />the Lorencito Canyon Mine. <br />IV. Proposed Decision <br />The Colorado Division of Reclamation, Mining, and Safety (DBMS) propose to approve an <br />application for an Industrial Land Use bond release for a portion of the Lorencito Canyon Mine. <br />This bond release is effectively a Phase I, II, and III release for 27.2 acres of disturbed area as <br />described in earlier sections of this document. The amount to be released is $50,952.00. As <br />required by Rule 3.03.1(2)(d), the bond amount of $916,169.00 is an amount sufficient to ensure <br />completion of all remaining reclamation in accordance with the approved plan at this time. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the Chronicle-News for two weeks as soon as possible. Requests for a public hearing must be <br />submitted to the Division in writing within thirty (30) days of the first publication of the notice in <br />the Chronicle-News. If no hearing is requested within 30 days, the Division's proposed decision <br />will become final. <br />
