III. COMMENTS-COMPLIANCE Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator during the field inspection. The loadout site was dry and the weather was sunny and somewhat windy. Roads The paved haul road was in good condition. The guard rail was up.The east entrance graveled road was in good condition as well. The east gate was open. The light use road along the railroad tracks was dry and passable. Hydrology The east side sediment pond was dry. The gated primary pipe valve was closed. The emergency spillway was functional. The pond embankment was well vegetated.Pond inslopes and outslopes were stable. The ditches at the loadout had sufficient capacity. The straw bales and silt fence at the railroad track small area exemption were in place. Signs and Markers The required information was on the mine id signs. These signs were located at the main entrance,east entrance and near the railroad tracks. Topsoil The east topsoil stockpile had a moderate vegetative cover. The collection ditch and the diversion ditch were well vegetated and had sufficient capacity. Topsoil signs were up.The west side topsoil stockpile was well vegetated and the topsoil signs were up on that stockpile as well. There were no indications of erosional problems on either stockpile. Facilities There was a moderate amount of stockpiled coal on the facilities bench.During the inspection, coal haul trucks were unloading and coal rail cars were being loaded.No problems with fugitive dust were observed.There were no signs of coal fines being tracked onto the main highway. There were no leaks at the fuel facility. The berm on the outside edge was in place and was functional. A pile of coal waste was sitting near the east pond.The coal waste will be transported to Oxbow's coal waste pile.There were no problems at the material storage area, substation, shop or mine office. c:/word/terror/insp04O8
