III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the field inspection. The loadout site was dry and the weather was sunny and somewhat windy. <br /> Roads <br /> The paved haul road was in good condition. The guard rail was up.The east entrance graveled road was in good <br /> condition as well. The east gate was open. The light use road along the railroad tracks was dry and passable. <br /> Hydrology <br /> The east side sediment pond was dry. The gated primary pipe valve was closed. The emergency spillway was <br /> functional. The pond embankment was well vegetated.Pond inslopes and outslopes were stable. The ditches at <br /> the loadout had sufficient capacity. The straw bales and silt fence at the railroad track small area exemption <br /> were in place. <br /> Signs and Markers <br /> The required information was on the mine id signs. These signs were located at the main entrance,east entrance <br /> and near the railroad tracks. <br /> Topsoil <br /> The east topsoil stockpile had a moderate vegetative cover. The collection ditch and the diversion ditch were <br /> well vegetated and had sufficient capacity. Topsoil signs were up.The west side topsoil stockpile was well <br /> vegetated and the topsoil signs were up on that stockpile as well. There were no indications of erosional <br /> problems on either stockpile. <br /> Facilities <br /> There was a moderate amount of stockpiled coal on the facilities bench.During the inspection, coal haul trucks <br /> were unloading and coal rail cars were being loaded.No problems with fugitive dust were observed.There were <br /> no signs of coal fines being tracked onto the main highway. <br /> There were no leaks at the fuel facility. The berm on the outside edge was in place and was functional. A pile of <br /> coal waste was sitting near the east pond.The coal waste will be transported to Oxbow's coal waste pile.There <br /> were no problems at the material storage area, substation, shop or mine office. <br /> c:/word/terror/insp04O8 <br />
